Terms of Service

1. Agreement to Terms

By accessing and using Viewsy's services, you agree to be bound by these Terms of Service. Viewsy Marketing Agency ("Viewsy", "we", "us", or "our") is a social media marketing agency located at 123 Social Street, Suite 500, Los Angeles, CA 90001, United States.

2. Services Description

Viewsy provides social media marketing services including but not limited to:

• Viral content strategy development and execution
• Social media account management and growth optimization
• Audience building and community management
• Paid advertising campaign management
• Analytics, reporting, and performance tracking
• Brand amplification across social platforms

Services are provided on a monthly subscription basis as outlined in your selected plan (Starter, Growth, or Enterprise). Specific deliverables are detailed in each plan and may be customized for Enterprise clients.

3. Payment Terms

All fees are charged in USD and billed monthly in advance. Payment is due upon signing the service agreement and at the beginning of each subsequent billing cycle. We accept payment via credit card, debit card, and ACH transfer through our secure payment processor.

Prices are subject to change with 30 days' notice. Late payments may result in service suspension. Any additional services beyond your plan scope will be billed separately with prior approval.

4. Client Responsibilities

Clients agree to:

• Provide timely access to social media accounts and necessary credentials
• Provide brand guidelines, assets, and content approval in a timely manner
• Respond to communications and requests within agreed timeframes
• Ensure all provided content complies with platform terms of service
• Maintain active social media accounts in good standing

5. Service Level and Guarantees

While we employ proven strategies and work diligently to achieve results, social media performance depends on many factors beyond our control. We do not guarantee specific follower counts, view numbers, or engagement rates. Results may vary based on industry, content quality, timing, and platform algorithm changes.

We guarantee delivery of services as outlined in your plan (e.g., number of posts, reports, support response times) but cannot guarantee specific performance outcomes.

6. Intellectual Property

Client retains ownership of all provided brand materials. Viewsy retains ownership of strategies, processes, and methodologies. Content created by Viewsy becomes the property of the client upon full payment, with Viewsy retaining the right to use such content for portfolio and marketing purposes unless otherwise agreed in writing.

7. Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the business relationship. This includes but is not limited to business strategies, account credentials, performance data, and unpublished content.

8. Limitation of Liability

Viewsy's liability is limited to the amount paid for services in the three months preceding any claim. We are not liable for indirect, incidental, or consequential damages including lost profits, data loss, or business interruption. We are not responsible for actions taken by social media platforms including account suspensions or algorithm changes.

9. Termination

Either party may terminate services with 30 days' written notice. See our Cancellation Policy for detailed terms. Upon termination, client will receive all completed work and access to accounts will be fully transferred back to the client.

10. Dispute Resolution

Any disputes will first be addressed through good-faith negotiation. If unresolved, disputes will be settled through binding arbitration in Los Angeles, California under the rules of the American Arbitration Association.

11. Changes to Terms

We reserve the right to modify these terms at any time. Clients will be notified of material changes via email at least 30 days before they take effect. Continued use of services after changes constitutes acceptance of new terms.
